Employment Training Panel (ETP) Core Program

ETP is a business and labor-supported state agency that funds the costs of vocational training. ETP is governed by an 8 member Panel. ETP is funded by a tax on employers, collected alongside the Unemployment Insurance tax. ETP receives no General Fund support. >The program is funded by the Employment Training Tax paid by California employers, and targets firms threatened by out-of-state competition or who compete in the global economy. >The program is performance-based. Employers must provide proof that training hours have been completed and trainees have been retrained in well-paying jobs for a specific period of time at a specified wage before ETP reimburses payment. >Since its inception in 1982, ETP has reimbursed employers well over $1 billion for training workers in more than 80,000 businesses. >For Incumbent Worker training, employers contribute to the cost of training. ETP also funds training for unemployed workers >ETP provides additional incentive to assist small businesses and employers in high unemployment areas of the State.

Eligibility and Requirements

TRAINEE ELIGIBILITY

Trainees have to reside within California and be employed by an eligible California employer with wages reported to the state.

 Frontline Workers: fulltime employees, directly producing or delivering goods or services, and subject to overtime compensation.

 Managers and Supervisors: may also be included in the Training Plan with the following exceptions:

o Limited to 20% or less of the training population

o Cannot include policy-making (level) employees (top level executives may be included in Small Business projects only)

o Can only include Frontline Managers/Supervisors if funded under the Special Employment Training (SET) Program

 Business Owners: Small Businesses may include Owners in training. An owner is an individual having all or a substantial (at least 20%) financial investment in the business, and is directly involved full-time in the day-to-day operation of the business. There is no wage requirement for owners. However, at least one employee must also participate in training.

 Top-Level Executives: Trainees employed in the occupations of President, Vice-President, Director, Chief Executive Officer, Chief Investment Officer, Chief Financial Officer, Chief Counsel, General Counsel, Chief Operating Officer, and other occupations of similar capacities who set company policy. Payment cannot be earned for top-level executives unless in a Small Business project.

 Temporary to Permanent Employees: Trainees while employed by a temporary employment agency may begin training as long as they are retained in permanent full-time employment on company payroll at 35 hours a week before starting their 90-day retention. Conversion to fulltime employment may not exceed 6 months from the start of training.

 Seasonal Employees: Trainees engaged in cyclical employment related to crop production seasons may participate in ETP funded training. Employment retention is not less than 500 hours within 12 months of the end-of-training with up to three employers in the crop production industry. Trainees need not be employed full-time (35 hours a week) during retention.


RETRAINEE JOB-CREATION

 Employer Eligibility: Employers must provide information to support their commitment to hire new employees such as:

o Opening specific new plants or facilities, expanding or upgrading existing facilities, and/or repurposing existing unused space/buildings or facilities;

o Expanding existing business capacity by adding a new production shift;

o Expanding existing business capacity by adding newly-hired employees to an existing function;

o The recall or rehire of laid-off workers (backfilling) is allowed, with justification to show that the company is renewing a workforce that was reduced due to economic conditions or other reasons leading to attrition.

 Trainee Eligibility: Trainee eligibility is determined based on the date of hire. Trainees must be hired into full-time permanent positions within the 3 months period prior to the date of project approval, or within the term of contract as long as training and retention can be completed within the term of the agreement. (ETP Fiscal will perform audits of hire dates prior to final payments.)
